Competition and Antitrust

Our Firm has extensive experience representing both Mexican and international clients in their antitrust matters in Mexico, including merger control notifications and antitrust investigations of varying levels of complexity.

We actively advise in the area of merger control (including in gun jumping cases and anticompetitive merger investigations) and in cases of cartel and abuse of dominance investigations (including advice in connection with the benefits and conditions of the leniency and sanction reduction programs of the Federal Economic Competition Commission (COFECE) and the Federal Telecommunications Institute (IFT)). In the area of merger control, we provide advice and support to clients throughout the entire process to obtain authorization from COFECE and/or IFT, as the case may be in order to complete mergers and acquisitions. We advise on various aspects of merger control, including in respect of the design of protocols of information exchanges among competitors, design and analysis of non-compete, non-solicitation and exclusivity agreements, and the design, negotiation, monitoring and compliance with conditions and remedies. In this regard, our Firm has extensive experience in concentrations, advising both buyers, sellers, and targets in a wide range of structures and transactions, in a wide range of markets and sectors.

In addition to the above, our Firm provides legal advice in the context of the general exercise of antitrust authority by COFECE and IFT, for instance, in the context of investigations to determine essential facilities or barriers to competition, proceedings to assess market power and competitive constraints in a wide range of markets, proceedings to obtain favorable antitrust opinions or resolutions as a precondition for the granting of concessions and permits, proceedings to seek the waiver and reduction of fines, and proceedings to obtain formal opinions and general guidance from the antitrust agencies.

We also specialize in conducting competition and antitrust audits and in the design and implementation of competition compliance programs.
