Our Firm has extensive experience representing both Mexican and foreign clients in antitrust enforcement matters in Mexico, as well as handling merger notifications and antitrust proceedings of varying levels of complexity.
We actively advise in the area of merger control and in cases of monopolistic practices and unlawful concentrations (including advice in connection with the benefits and conditions of the immunity and sanction reduction programs of the Federal Economic Competition Commission (COFECE) and the Federal Telecommunications Institute (IFT)). In the area of merger control, we provide advice and support to clients throughout the entire process to obtain authorization from COFECE or IFT, depending on which agency has jurisdiction to exercise merger control authority, in order to complete mergers and acquisitions. We advise on aspects of merger control, including in respect of matters involving information exchanges among competitors, design, and analysis of non-compete and non-solicitation agreements and exclusivity agreements, and the negotiation and monitoring and compliance with conditions and remedies. In this regard, our Firm has extensive experience in all types of concentrations, advising both buyers, sellers, and targets in a wide range of structures and transactions in all types of markets and sectors.
In addition to the above, our Firm provides legal advice in the context of the general exercise of antitrust authority by COFECE and IFT, for instance, in the context of investigations to determine essential inputs or barriers to competition, proceedings to assess market power and competitive constraints in a wide range of markets, proceedings to obtain favorable antitrust opinions or resolutions as a precondition for the granting of concessions and permits, proceedings to seek the waiver and reduction of fines, and proceedings to obtain formal opinions and general guidance from the antitrust agencies.
We also specialize in conducting competition and antitrust audits and in the design and implementation of competition compliance programs.
